Fairfield County Clerk of Courts Arrested Today

Wednesday, October 2, 2013

Columbus – Warrants were issued today for the arrest of Fairfield County Clerk of Courts Deborah Smalley and husband David Smalley.  Deborah Smalley was charged with one count of theft in office, a felony of the third degree.  Husband David Smalley was charged with one count of complicity to unlawful interest in a public contract, a felony of the fourth degree.

“Violation of the public trust is the worst sort of theft because it makes all of us victims, and shreds our confidence that those who govern will do the right thing,” Auditor Yost said.  “We will continue to fight for accountability and justice.”

Auditor of State Assistant Legal Counsel Robert Smith was appointed special prosecutor in the case in July.  A special audit of the Fairfield County Clerk of Courts office was launched on August 6, 2013 and work is ongoing.
