Statement from Auditor of State Dave Yost

Columbus – The following statement may be attributed to Auditor of State Dave Yost concerning the indictments of former Fairfield County Clerk of Courts Deborah Smalley and husband David Smalley:

“No elected official is above the law — but neither is any elected official beneath it,” Auditor Yost said.  “This indictment brings Ms. Smalley to the bar of justice, where she will get her day in court."

Auditor of State Assistant Legal Counsel Robert Smith was appointed special prosecutor in the case on July 23, 2013.  The Auditor of State’s office received information from a former clerk of courts employee in June 2013 and launched a special audit into Smalley’s actions in August 2013.  The special audit is ongoing.
